PRIVACY STATEMENTS
The following privacy statements provide basic information as to the reasonable privacy expectations of persons using the eCourt web portal and the electronic case and document management and filing system (“eCourt”) and persons who are involved in matters before the Court of Appeal for Saskatchewan (the “Court”).
The Court Record
In Canada, the openness of court proceedings is a fundamental constitutional principle that ensures public confidence in the integrity of the court system, better understanding of the administration of justice and accountability of the judiciary. This means that the public has a general right to attend at and observe the proceedings in any courtroom. Another practical effect of this constitutional principle is that all information that becomes part of the court record is open to public scrutiny, unless it is subject to a statutory or court-ordered publication or disclosure ban.
Accordingly, there is no reasonable expectation of privacy, or of confidentiality, in respect of any personal information, commercial information or other information contained in or that otherwise becomes part of the court record.
The Court and the Registrar of the Court of Appeal for Saskatchewan (the “Registrar”) will exercise every reasonable effort to ensure that accessibility of file information, data and materials on eCourt is consistent with statutory or court-ordered publication and disclosure bans. Nevertheless, it remains the sole responsibility of persons using eCourt, or otherwise accessing or relying on an electronic file in eCourt, to personally comply with any ban on publication or disclosure. Do not misconstrue the availability of file information, data or materials on eCourt as a representation that the file information, data or materials is not subject to a publication and disclosure ban.
Approved Filer Information
You need an approved filer account to access eCourt. To create an approved filer account, the Registrar will obtain (or generate) and retain some personal information about you, including, without limitation, your name, email address and a password. The Registrar takes reasonable steps to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of retained approved filer information, including appropriate encryption and physical security measures.
When you use eCourt in a way that gives rise to a fee, you will be asked to enter credit card information to facilitate payment of that fee. All eCourt fee payments are processed through a third party online payment processing agent. Neither the Registrar nor the Court obtain, retain or have access to your payment information.
When you access eCourt, the eCourt servers record a server log containing certain information that your browser automatically sends to the eCourt servers, which may include your web request, your interaction with eCourt, your Internet Protocol address, your browser type, your browser language, the date and time of your request and one or more cookies that may uniquely identify your browser or your approved filer account. The collection and retention of this technical information is necessary or recommended for the proper functioning of eCourt. The Registrar will not attempt to associate any anonymous technical information collected by eCourt with any personally-identifiable information unless the Registrar or eCourt administrators have detected, or reasonably suspect, an attempt to damage or breach the security of eCourt or a breach of the Terms of Use.
When you send email or other communications through eCourt or otherwise communicate with the Registrar, the Registrar will retain those communications, place them on the court record, and may respond to your communications, if required. The Registrar may use your email address to communicate with you about eCourt and matters before the Court.
You may terminate your approved filer account at any time.
